Lawsuit

 

Town of Carolina Shores (plaintiff) vs Carolina Shores POA (defendant)

 

The final ruling is posted on the Town’s website under news. Both the Town and the POA had the right

to appeal but neither chose to do so.

 

The Town of Carolina Shores is a member of the POA by owning lot 44 on Carolina Shores Parkway and

lot 1 on Persimmon Rd. The suit was filed by the Town to negate previous dues, fines, and restrictions

as outlined in the Deed of Restrictions (DOR).

 

The results are as follows-

 

The Town asked to be removed from the POA jurisdiction but the judge denied the request. This means

the two lots owned by the town can only be used for single family housing. Previous improvements to

these lots remain in place; however, hence forward DOR restrictions prevail.

 

The ruling defines the Town of Carolina Shores as a non-profit municipally, and therefore is deemed as

tax exempt. This means the town is not subject to annual dues or fines.

 

We hope that both parties can move forward as this is in the best interest of everyone.

Resident requests from the last Board meeting-

 

Residents along Carolina Shores Parkway and Pinewood have been working with the Highway Patrol and the Sheriff’s Department to slow down the speeders on these roads. The speed limit is 25mph but vehicles have been estimated to be traveling in excessive of 40mph.  I have contacted the Town Administrator for his advice in solving this problem.  The residents were asking about speed bumps.

 

Brunswick Electric recently trimmed trees along Pinewood and left the debris on the undeveloped lots.  I talked to BEMC about this problem and the subcontractor is required to remove the trimmings.  They are to notify the subcontractor to remove this debris.

Recreation Facilities – Kelly Wilson

 

POOL, TENNIS AND REC-AREA INFORMATION

 

            With the pool deck recently getting its yearly power washing along with the rest of the rec area we will be re-sanding some of the trouble spots we had last year from all the dampness. We will also be repairing and re-sanding some of the pavers that have sunk down and bring them back to level along with the sidewalk area to the pool.

 

            Staining of the benches at the Boccie Ball courts and painting others will begin in April also to refresh everything for the upcoming season. Rock will be moved from the pool area to open it up more.

 

            Pool furniture that was used last year will be getting a face lift and furniture will be washed and cleaned for the upcoming season. With some restrictions being lifted, as to outdoor pools, we will open up completely to all members again this year and wait before opening if restrictions need to be in place. We are planning on a Mother’s Day weekend opening and hoping everything will be back to normal. As last year, keeping our own members safe is our highest priority.

 

            We should be hearing shortly from the company on the repair of the tennis courts and costs. As soon as we know more we will pass this along. Tennis is still being played Monday, Wednesday, and Fridays 8:30 to 9:30. Pickle Ball is being played Saturday, Sunday, and Tuesdays and all are welcome to play.

 

            The Recreation Area has undergone a transformation for the upcoming season. We had trees removed to open and clean the area up, helping in air circulation. Power washing of the walking areas, signage and pavilion area all have been completed. The parking area will be receiving its topcoat next month with new lines painted. Please watch for dates when the rec area parking will be closed off for this.

 

Pool Attendants Needed

 

            We are looking for anyone in our neighborhood that may be willing to work as a pool attendant or back up attendant for the upcoming season. Days would be 2/3 days a week with other days available before opening for one and a backup attendant on call for when needed. It is that time of the year to address our yards. The Declaration of Restrictions require all properties to be well maintained, free of debris and clutter. This includes shrubs, roofs and gutters. If you require the use of a yard or utility trailer to remove debris or bring in materials such as mulch, you are not allowed to have a trailer stored on your property overnight under the Rules and Regulations section III, paragraph B1 and the Declaration of Restrictions section 6, sub-section 9. There is an exception to this rule. If you need to keep a trailer overnight to complete your work or finish unloading materials, you can do this for 24 hours, but you are required to notify the POA. This can be done by email or a phone call. There is an answering machine available 24 hours a day.

 

As always, you can call the ACC for guidance with any questions regarding planned projects or alterations. Thank you in advance for your cooperation.

 

                                                                                   

 

IMPORTANT: We seem to have a much larger number of unpaid invoices than normal this year. Annual POA dues that have not been paid are now considered delinquent. We will be sending out late letters on April 1, 2021. These letters are sent certified mail and regular mail and advise members who have not paid that we will be seeking collection within thirty (30) days or a lien will be filed on the delinquent properties. Please avoid receiving this letter by checking your records to make sure that your dues have been paid. If your records show payment, please do not call the office. If you are uncertain whether you paid your dues, please call the POA office at 579-2044.

 

                                                                                   

 

Low Impact Chair Aerobics Mary Timothy

 

Chair Aerobics will be exercising Monday through Saturday at 10:00 a.m. at the pavilion. You will need to bring a folding chair, weights and a bottle of water. Wear layers of clothing to be prepared. April is here and it is getting warmer, and our days will be longer. All the more reason to get out and play pickleball. Pickleball is a great sport to play to stay active and meet new people. It is the fastest growing sport in the U.S. for people over 55.

 

Wear Tennis shoes and comfortable clothing. Paddles and Balls are available to use. Pickleball is somewhat COVID safe. The sport is played outside, and 6 feet distancing is maintained most of the time.

Now that the clubhouse is open, we can again access our library. It is an "on your honor" collection - take what you wish and return when you can. All returns should be placed in the plastic bin by the window.

 

We can always use popular fiction and non-fiction, both paperback and hardback and current issues of magazines of general interest. All donations should be placed in the plastic bin by the window. Our volunteers will shelve the books. Since our space is limited, books with a copyright from ten (10) years passed to the present one can be included (i.e. c2011 to c2021). The copyright is usually on the back of the title page. We cannot take over sized "coffee table" like books or those of a specialized nature. No How-to, cookbooks, computer instructions, financial advice, and the like. Audio books on disc would be very welcomed as well as puzzles. If you are donating a puzzle, please put the pieces in a plastic bag. Book Discussion Group – Susie Riggs

After a year of gathering outside at the pavilion, our group was finally able to meet in the clubhouse again with thirteen members attending. While wearing masks and sitting several feet apart in the large room, we enjoyed discussing our two reading selections from February, Clock Dance by Anne Tyler and Library of the Lost and Found by Phaedra Patrick, as well as our March title, The Indigo Girl by Natasha Boyd. As usual, there were quite a few varying opinions about all three books, but we agreed that they were excellent choices for our group to read.

 

Our next meeting will be held at the POA clubhouse on Friday, April 16, at 10:00 a.m. Our reading selection for the month is The Magic Hour by Kristin Hannah. All interested Carolina Shores readers are invited to join us to discuss this compelling novel written by one of today’s best-selling authors.

 

                                                                  

 

Garden Club Mary Conover

Our March meeting was held on the 10th with a terrific turnout. The warm sunshine and exciting program certainly helped! Our speaker was Mary Keefe, owner of Yardbird Emporium in Calabash. She shared general information on local birds, birdhouses and particularly Hummingbirds and Bluebirds. It was very informative!

 

The next meeting will be Wednesday, April 14, with an opportunity to get together under the pavilion, while practicing all the required safety precautions. Our speaker will be Wanda Maggard, Master Gardener, who will speak to us about deer resistant plants. A reminder to members that April is our traditional "Plant Exchange," where we bring indoor/outdoor plants, books, tools, etc. to exchange with like-minded gardeners.

 

The Garden Club meets the second Wednesday of each month, September to May, at 1:00 p.m. Dues are $10/year. The pavilion is located at the Carolina Shores Recreation Area, next to the pool. POP UP BIRTHDAY PARADE Joyce Dunn

 

BDAYIf you were anywhere near Canal Way Court on March 1, your ears were probably pounding from all the honking horns. The noise was made by people attending a special Pop-Up Birthday Parade that was held to honor Marlene Stewart. Twenty or more cars lined up and drove by Marlene, who was sitting in her driveway. There were birthday cards, balloons and flowers everywhere. Each car got a chance to stop and personally wish Marlene a happy birthday. For the past several years Marlene has been very ill and unable to participate in her usual activities. She has long been a mover and shaker in our community, so her friends wanted to let her know she is not forgotten. It was a great parade and Marlene really enjoyed the day. Help with a small chore at home, an occasional ride, a temporary need for dog walking, etc. is usually what is needed.
